These Terms and Conditions ("Terms") outline the rules and regulations governing your use of the Art Nomad website and services. You agree to comply with these Terms by accessing or using our platform. If you do not agree with any part of these Terms, please refrain from using our services.

1. Acceptance of Terms

1.1 By accessing or using the Art Nomad website ("Platform"), you acknowledge that you have read, understood, and agree to be bound by these Terms, including our Privacy Policy and any other relevant agreements.

1.2 If you do not agree to these Terms, please do not use our Platform.

2. Definitions

2.1 "Art Nomad," "we," "us," or "our" refers to the Art Nomad platform.

2.2 "User," "you," or "your" refers to any individual, artist, buyer, or entity accessing or using the Art Nomad Platform.

3. Use of the Platform

3.1 You must be at least 18 years old to access and use our Platform. By using the Platform, you represent and warrant that you are at least 18 years old.

3.2 You agree to use the Platform for lawful purposes and in accordance with these Terms.

3.3 We reserve the right to modify, suspend, or discontinue any aspect of the Platform at any time without notice.

4. Account Registration

4.1 In order to access certain features of the Platform, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

4.2 You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4.3 You agree not to share your account credentials or access the account of another User.

5. Artwork Representation and Colour Accuracy

5.1 The images of Artwork displayed on our platform are for illustrative purposes only. We have taken care to accurately represent the colours, but we cannot guarantee that your device's display will precisely reflect the colour of the Artwork.

6. Packaging Variation

6.1 The packaging of Physical Artwork may differ from the images shown on our platform.

7. Descriptions and Specifications

7.1 Any descriptions, specifications, or illustrations provided by Art Nomad and its partners, including those in marketing materials, are intended to give an approximate idea of the Artwork. Such descriptions are not part of these terms and conditions, and this is not a sale by sample.

8. Artwork Description in Invoice

8.1 The details of the Artwork you purchase will be specifically described in the Invoice provided by Art Nomad.

9. Unavailability of Specific Artwork

9.1 If the specific Artwork (excluding Bespoke Artwork) is unavailable on the date of the Invoice, Art Nomad will promptly notify you in writing. With your written agreement, Art Nomad will have a 30-day period from the order date to source similar Artwork of equal or higher quality (referred to as 'Similar Artwork'). Art Nomad will then have an additional 30 days from the Source Date to deliver or make the Similar Artwork available to you.

10. Failure to Source Acceptable Artwork

10.1 If Art Nomad is unable to source Artwork (excluding Bespoke Artwork) that meets your approval within the timeframe specified in clause 9.1, you have the option to contact us to terminate the contract. In such cases, you will be entitled to a refund for any payment made for Artwork (excluding Bespoke Artwork) that you have not yet received.

12. Modifications to Terms

12.1 We reserve the right to modify or update these Terms at any time. Any changes will be effective upon posting the revised Terms on our Platform. Your continued use of the Platform after any changes signifies your acceptance of the modified Terms.

13. Governing Law

13.1 These Terms and your use of the Platform shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law principles.
